The terms and conditions for using TEAM A.M.P.S.

TEAM A.M.P.S. ("we", "us", or "our") operates the TEAM A.M.P.S. platform (the "Platform"). By accessing or using the Platform, you ("you" or "your") agree to be bound by these Terms of Service (these "Terms"). If you do not agree to these Terms, do not use the Platform. If you are using the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

TEAM A.M.P.S. is a sports management platform for baseball and softball programs. The Platform provides tools for roster management, live game scoring, stat tracking, payment collection, recruiting profiles, training programs, and league operations. The Platform is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.
To use the Platform, you must create an account with accurate and complete information. You are responsible for:
Account holders must be at least 13 years of age. Users between 13 and 17 may hold accounts only with the consent of a parent or legal guardian.
Children under 13 may not register their own accounts. Profiles for athletes under 13 are created and managed by a parent or legal guardian, or by an organization acting with verifiable parental consent in accordance with the Children's Online Privacy Protection Act (COPPA). Please see our Privacy Policy for details on how we handle children's personal information.
Parents and legal guardians are responsible for their minor's use of the Platform and may manage, review, and request removal of their minor's information as described in our Privacy Policy.
The Platform supports multiple user roles (athlete, parent, coach, org owner, league owner, scout). Each role has specific permissions and access levels. Organization owners and coaches are responsible for managing access within their organizations. You agree to use only the features and data appropriate to your assigned role.

Certain features require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). By subscribing to a paid plan, you agree to:
Subscriptions automatically renew at the end of each billing period until you cancel. Cancellation takes effect at the end of the current billing period; you will continue to have access until that date. Platform subscription fees are non-refundable except where required by applicable law.
You are responsible for all applicable taxes associated with your subscription. All payments are processed through Stripe. We reserve the right to change pricing with 30 days' notice.
We may suspend access to your account pending resolution of any chargebacks or payment disputes.
If you use the Platform to collect payments from athletes, parents, or members (registration fees, dues, etc.), you are responsible for complying with all applicable laws and regulations. TEAM A.M.P.S. facilitates payment processing through Stripe Connect but is not a party to transactions between organizations and their members. Refunds for organization charges are governed by the organization's own refund policies.
Organizations may require participants to agree to the organization's own terms, waivers, releases, or consents as part of registration, including participation agreements, liability releases, and media or name, image, and likeness (NIL) consents. TEAM A.M.P.S. facilitates the presentation and electronic signature of such documents on the organization's behalf but is not a party to them, does not provide legal advice regarding their content, and is not responsible for their content, accuracy, or enforceability. Any grant of rights to use an athlete's name, image, or likeness is made to the organization (and any entities the organization identifies), not to TEAM A.M.P.S.
You retain ownership of all content and data you submit to the Platform (including athlete profiles, stats, images, and organizational data). By using the Platform, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your content as necessary to provide the service. This license ends when you delete your content from the Platform, except that copies may persist in routine backups for a reasonable period and in records retained for legal compliance.
You represent and warrant that you have all rights, licenses, and consents necessary for any content you submit, including parental or guardian consent for any minor's photos, likeness, or personal information.
Stats are generated from data entered during live scoring sessions. TEAM A.M.P.S. provides tools to calculate and aggregate statistics but does not independently verify the accuracy of scored data. Organization owners and scorers are responsible for the accuracy of game data entered into the Platform.
The Platform provides tools to create athlete profiles and connect with college scouts. TEAM A.M.P.S. does not guarantee recruiting outcomes, scout engagement, or scholarship offers. We are not a recruiting agency and do not make representations about the likelihood of recruiting success.
Athlete profiles of users under 18 may be made publicly visible to scouts only with verifiable parent or guardian consent. Such visibility can be revoked at any time through account settings.
By providing your email address, you consent to receive transactional communications from us (e.g., account verification, security alerts, payment receipts, and service updates). We may also send marketing or promotional emails, from which you may opt out at any time by using the unsubscribe link in any such email.
If you opt in to receive SMS or text messages, you may stop them at any time by replying STOP. Standard message and data rates may apply.
The TEAM A.M.P.S. platform, including its design, code, features, and branding, is owned by TEAM A.M.P.S. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without written permission.
We respect the intellectual property rights of others. If you believe that content on the Platform infringes your copyright, you may submit a notice of claimed infringement. We may remove allegedly infringing content and may terminate the accounts of repeat infringers.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, abuse of the Platform, or any other reason at our discretion. You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately, though we may retain certain data as required by law or for legitimate business purposes.
To the maximum extent permitted by law, TEAM A.M.P.S. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Platform. Our total aggregate liability for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim or (b) one hundred dollars ($100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We are not responsible for data loss due to technical failures, though we take reasonable measures to protect your data.
You agree to indemnify, defend, and hold harmless TEAM A.M.P.S. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your content; (b) your use of the Platform; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right, including the privacy rights of any minor.
These Terms are governed by and construed in accordance with applicable United States federal and state law. You agree that any legal action or proceeding arising out of or relating to these Terms or the Platform shall be resolved in accordance with applicable law.
We may update these Terms of Service from time to time. Material changes will be assigned a new effective date and communicated through the Platform or by email. Your continued use of the Platform after the updated effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform.
